Terms of Service

Agreement

By creating an account or using the Dead Media mobile application ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. Dead Media Labs ("we", "us") reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance.

Eligibility

You must be at least 13 years old to use Dead Media. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

Your Account

• You are responsible for maintaining the security of your account credentials.
• You may not impersonate other users, public figures, or organizations.
• One account per person. Duplicate or bot accounts will be removed.
• You can delete your account at any time from the Settings screen. Deletion is permanent and removes all your data.

User Content

You retain ownership of content you submit — including collection data, reviews, spine photographs, and listing photos. By posting content, you grant Dead Media Labs a non-exclusive, worldwide, royalty-free license to display, distribute, and store that content within the App.

• Spine photographs you contribute are shared with all users to improve the collective database. You may not upload spines you did not photograph yourself.
• Reviews and ratings are public and visible to other users.
• Listing photos must accurately represent the item being sold.

We reserve the right to remove content that violates these Terms without notice.

Analytics & Privacy

The App uses privacy-friendly analytics (PostHog) to understand how features are used and to improve the experience. You can opt out of analytics tracking at any time in Settings > Privacy. For full details on data collection and your rights, see our Privacy Policy.

Prohibited Conduct

You agree not to:

• Post fraudulent marketplace listings or misrepresent item condition.
• Harass, threaten, or abuse other users through messaging or reviews.
• Upload illegal, obscene, or offensive content.
• Attempt to scrape, reverse-engineer, or interfere with the App's operation.
• Use the App to facilitate transactions outside the marketplace to circumvent fees (when applicable).
• Create automated accounts or use bots to interact with the App.

Marketplace

Dead Media provides a platform for users to list and discover physical media for sale. We are not a party to any transaction between buyers and sellers.

• Sellers are responsible for the accuracy of their listings, including item condition, photos, and pricing.
• Buyers are responsible for evaluating listings before purchasing.
• Transactions, payments, and shipping are handled directly between buyer and seller. Dead Media does not process payments, hold escrow, or guarantee delivery.
• Disputes between buyers and sellers are their responsibility to resolve. We may assist at our discretion but are not obligated to do so.

Dead Media is a marketplace platform, not a retailer. We do not own, inspect, or ship any items listed by users.

Intellectual Property

Movie and TV show metadata, posters, and cast information are provided by TMDB. Dead Media is not endorsed or certified by TMDB. All film-related intellectual property belongs to its respective owners.

The Dead Media name, logo, and app design are the property of Dead Media Labs. You may not use our branding without written permission.

Termination

We may suspend or terminate your account at our sole discretion if you violate these Terms, engage in prohibited conduct, or if your use of the App poses a risk to other users. We will make reasonable efforts to notify you, but are not required to do so in urgent cases.

Upon termination, your right to use the App ceases immediately. You may request an export of your data by contacting support@deadmedialabs.com within 30 days of termination.

Disclaimers & Limitation of Liability

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free from data loss. Collection values and price estimates are informational only and not financial advice.

To the maximum extent permitted by law, Dead Media Labs' total liability to you for any claims arising from or related to your use of the App shall not exceed the amount you have paid to Dead Media Labs in the twelve (12) months preceding the claim, or fifty U.S. dollars ($50), whichever is greater.

In no event shall Dead Media Labs be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to losses from marketplace transactions, data loss, lost profits, or service interruptions, regardless of the theory of liability.

Indemnification

You agree to indemnify, defend, and hold harmless Dead Media Labs and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the App or violation of these Terms.
• Content you submit, including reviews, spine photographs, listing photos, and messages.
• Your marketplace transactions with other users.
• Your violation of any third-party rights, including intellectual property rights.

Copyright & DMCA

We respect intellectual property rights. If you believe content on Dead Media infringes your copyright, submit a takedown notice to support@deadmedialabs.com with the following:

• Identification of the copyrighted work you claim is infringed.
• Identification of the infringing content and its location within the App (e.g. a listing URL, username, or description).
• Your contact information (name, address, email, phone).
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner.
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
• Your physical or electronic signature.

We will review valid notices and remove infringing content promptly. Repeat infringers may have their accounts terminated.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If unresolved after 30 days, either party may pursue resolution through binding arbitration administered under the rules of the American Arbitration Association (AAA). Arbitration shall take place in Arizona, and the arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.

You agree to resolve disputes on an individual basis. Class actions and class arbitrations are not permitted under these Terms. For claims under $10,000, arbitration may be conducted entirely online or by phone at your election.
